1. 接受条款
下载、安装或使用 MagixDiary iOS 应用，即表示你同意本条款与《隐私政策》。如果你不同意，请停止使用并删除应用。若你未达到所在地独立同意本条款的年龄，应由监护人阅读并同意。
应用提供者为 App Store 产品页“提供者”字段所列主体（下称“MagixRealm”或“我们”）。本条款适用于 iOS 版本，不包含 Android 专属的广告、Google、厂商登录或国内支付安排。
2. 服务内容
MagixDiary 提供本地日记创建、自由画布、手写、媒体对象、主体分离、预览、搜索、项目包导入导出、视频生成以及通过 StoreKit 提供的可选 Premium 权益。系统相册、相机、麦克风、文件、分享和购买界面由 iOS 或 Apple 服务承载。
当前 iOS 版本以本地存储为主，不保证提供 MagixRealm 账号、云同步、跨设备备份或服务器恢复。除非产品页面另有明确说明，你应自行决定是否创建并妥善保管导出备份。
3. 许可与所有权
在你遵守本条款的前提下，我们授予你一项个人、有限、非独占、不可转让、可撤销的许可，仅用于在你拥有或控制的 Apple 设备上使用 MagixDiary。应用、品牌、界面、代码、内置素材及其知识产权归其合法权利人所有；开源组件继续适用各自许可证。
你保留对自己创作或导入内容的权利。你应确保拥有保存、编辑、导出和分享相关文字、照片、视频、音频、字体或素材所需的权利和同意。由于当前日记默认仅在设备上处理，你不会仅因把内容存入 MagixDiary 而授予我们用于广告、训练或公开传播的许可。
4. 合理使用
你不得：
- 利用应用侵害他人的隐私、肖像、著作权或其他合法权益；
- 绕过购买验证、安全机制、加密或访问控制；
- 对应用进行恶意攻击、传播恶意代码，或以违反适用法律的方式使用导出/分享能力；
- 转售应用、内置素材或 Premium 权益，或虚假表示与 MagixRealm、Apple 存在授权关系。
5. 本地数据、备份与设备风险
日记和媒体默认存储在应用沙盒并采用加密保护。设备损坏、系统故障、误删、卸载、存储空间不足或密钥不可访问仍可能导致数据丢失。你应在处理重要内容时创建合适的导出备份，并验证备份可以打开。
无密码便携项目包的目的在于迁移，不声明机密性；密码保护项目包应使用独立且足够强的密码。忘记密码时，我们无法恢复加密包。通过照片、文件或分享面板生成的副本由你选择的目标位置管理。
6. Premium 与购买
可选数字商品通过 Apple StoreKit 提供。实际商品名称、期限、价格、货币、试用和优惠以购买前 App Store 界面显示为准。购买由 Apple 处理；恢复购买用于重新取得可恢复权益。年度订阅会自动续费，除非你在 Apple Account 的订阅设置中关闭续费。Lifetime 为一次性非消耗型购买，不会自动续费。
购买基础记录能力不是使用日记的前提。详细规则见《自动续费服务说明》。退款、付款争议和 Apple Account 问题应依 Apple 规则向 Apple 申请。
7. 更新、变更与停止
我们可能为安全、兼容、合规或产品改进而更新应用。某些更新可能调整界面、素材、系统要求或可选功能，但不会在未说明的情况下把私密日记用于广告画像。若某项服务必须停止，我们会在合理可行范围内提供说明；本地内容的可访问性仍可能受设备、系统版本和应用兼容性影响。
8. 第三方和 Apple 服务
App Store、StoreKit、Photos、Files、分享面板及其他 Apple 服务由 Apple 提供并适用 Apple 的条款与隐私政策。你通过分享面板选择的第三方应用、存储服务或收件人由其自行负责。我们不控制这些外部服务的可用性或处理方式。
9. 免责声明与责任限制
在适用法律允许的最大范围内，应用按“现状”和“可用”状态提供。我们不保证应用永不中断、无错误或能够恢复所有误删/损坏内容。任何责任限制均不影响适用消费者保护法下不可排除的权利；对于因故意或重大过失、侵犯人身权益或法律禁止限制的责任，本条不作排除。
10. 终止、法律与联系
你可以随时停止使用并删除应用。严重违反本条款、安全要求或法律时，我们可以在法律允许范围内限制相关权益。强制适用的消费者保护和管辖规则优先；其他争议应先通过 App Store 产品页“App 支持”渠道联系解决。

1. Acceptance
By downloading, installing, or using MagixDiary for iOS, you agree to these Terms and the Privacy Policy. If you do not agree, stop using and remove the app. A guardian must review these Terms if local law does not allow you to consent independently.
The provider is the entity identified on the App Store product page (“MagixRealm”, “we”, or “us”). These Terms cover iOS and do not import Android-only advertising, Google, vendor login, or regional payment arrangements.
2. Service
MagixDiary provides local diary creation, a free canvas, handwriting, media objects, foreground separation, preview, search, package import/export, video generation, and optional Premium entitlements through StoreKit. Apple or iOS provides the system Photos, Camera, Microphone, Files, Share, and purchase surfaces.
The current iOS release is local-first and does not promise a MagixRealm account, cloud sync, cross-device backup, or server recovery unless explicitly stated on the product page. You are responsible for deciding whether to create and protect exported backups.
3. License and content ownership
Subject to these Terms, we grant a personal, limited, nonexclusive, nontransferable, revocable license to use MagixDiary on Apple devices you own or control. The app, brand, interface, code, and built-in materials remain the property of their respective owners; open-source components retain their licenses.
You retain rights in content you create or import and are responsible for having permission to store, edit, export, and share it. Storing content locally does not grant us a license to use it for advertising, model training, or public distribution.
4. Acceptable use
Do not infringe privacy or intellectual-property rights, bypass purchase verification or security controls, attack the app, distribute malicious code, use exports unlawfully, resell the app or entitlements, or misrepresent an affiliation with MagixRealm or Apple.
5. Local data and backups
Diaries and media are encrypted in the app sandbox, but device failure, system errors, deletion, uninstall, storage pressure, or inaccessible keys can still cause loss. Create appropriate backups for important work and verify that an export opens. Portable packages without a password are for transfer and do not claim confidentiality. We cannot recover a forgotten package password.
6. Premium and purchases
Optional digital products use Apple StoreKit. Product name, duration, price, currency, trial, and offer details are those shown by the App Store before purchase. Annual subscriptions renew automatically unless disabled in Apple Account subscription settings. Lifetime is a one-time non-consumable purchase and does not renew. Core diary recording is not conditioned on a purchase. See the Auto-Renewal Service Notice for details. Apple handles refunds, billing disputes, and Apple Account issues under its rules.
7. Updates and availability
We may update the app for security, compatibility, compliance, or product improvements. Features, materials, interfaces, and system requirements may change. No update silently authorizes advertising use of private diaries. Local access may still depend on device, OS, and app compatibility.
8. Apple and external services
Apple provides the App Store, StoreKit, Photos, Files, sharing, and other system services under Apple’s terms and privacy policy. A destination app, storage provider, or recipient you select through sharing controls its own copy. We do not control those external services.
9. Disclaimers and liability
To the maximum extent permitted by law, the app is provided “as is” and “as available.” We do not promise uninterrupted or error-free operation or recovery of every deleted or damaged item. This does not limit non-waivable consumer rights or liability that applicable law prohibits us from excluding.
10. Termination, law, and contact
You may stop using and remove the app at any time. We may restrict affected entitlements for serious violations where lawful. Mandatory consumer-protection and jurisdiction rules prevail. Contact us first through the App Support channel on the App Store product page.
